Purpose
To define the geographical boundaries of the legal jurisdiction and patrol service area for the Indiana University Police Department (IUPD).
General Order
The IUPD has primary jurisdiction over the real property owned or occupied by Indiana University (IU), including the streets passing through and adjacent to IU.
Definitions
Extended jurisdiction – Is defined in IU policy PS-PD-01 Exercise of Extended Jurisdiction by Officers of the Indiana University Police Department as any areas within the State of Indiana beyond the primary jurisdiction in which the Indiana University Board of Trustees has authorized university police to exercise police powers.
Noncampus building or property – Is defined in the Clery Act as any building or property owned or controlled by a student organization that is officially recognized by the institution; or any building or property owned or controlled by an institution that is used in direct support of, or in relation to, the institution’s educational purposes, is frequently used by students, and is not within the same reasonably contiguous geographic area of the institution.
On campus – Is defined in the Clery Act as any building or property owned or controlled by an institution within the same reasonably contiguous geographic area and used by the institution in direct support of, or in a manner related to, the institution’s educational purposes, including residence halls; and any building or property that is within or reasonably contiguous to that area that is owned by the institution but controlled by another person, is frequently used by students, and supports institutional purposes.
On campus student housing facility – Is a subset of on campus under the Clery Act and is any student housing facility that is owned or controlled by the institution, or is located on property that is owned or controlled by the institution, and is within the reasonably contiguous geographic area that makes up the campus.
Patrol jurisdiction – Is a Clery Act term and means any property that does not meet any of the Clery Act geographic area definitions, but which is regularly provided with police or security patrol services by the IUPD.
Primary jurisdiction – Is defined in IU policy PS-PD-01 Exercise of Extended Jurisdiction by Officers of the Indiana University Police Department as the area within which Indiana Code (IC) 21-39-4-6 allows IU police officers to exercise police powers, which is defined as the real property owned or occupied by IU, including the streets passing through and adjacent to IU.
Public property – Is defined in the Clery Act as all public property, including thoroughfares, streets, sidewalks, and parking facilities, that is within the campus, or immediately adjacent to and accessible from the campus.
Jurisdiction and Service Boundaries
The geographical boundaries of the IUPD’s legal jurisdiction and patrol service area are the locations that fall under the definition of primary jurisdiction.
With the approval from the superintendent for public safety, the IUPD may enter into an agreement with a local agency or entity for the IUPD to regularly provide police or security patrol services for a certain geographic area that is outside the IUPD’s primary jurisdiction. If such an agreement exists, the area described in the written agreement is identified as a patrol jurisdiction.
The IUPD maintains maps which depict the geographical boundaries of IUPD’s legal jurisdiction and patrol service area for the areas in and around the main campus. The IUPD also maintains maps that are color coded to identify areas that fall under the Clery geography categories (on campus, on campus student housing facility, noncampus building or property, public property, and patrol jurisdiction). Due to Clery Act regulations, certain areas on these maps are identified as within Clery reportable geography but may not fall within the primary jurisdiction of the IUPD. Examples include area hospitals and public parks.
The IUPD will not routinely patrol or provide any police or security services to any other area that is not identified as an area of primary jurisdiction or patrol jurisdiction.
The IU Board of Trustees authorizes IUPD officers who have been certified by the State of Indiana as required under IC 21-39-4-6(a)(2) to exercise their police powers throughout the State of Indiana subject to the terms and restrictions outlined in IU policy PS-PD-01 Exercise of Extended Jurisdiction by Officers of the Indiana University Police Department.
