Purpose
To state the procedures used for situations in which a Title IX investigation and a criminal investigation occur concurrently.
General Order
All employees of the Indiana University Police Department (IUPD) are identified as “Responsible Employees” under Indiana University Policy UA-03 Discrimination, Harassment, and Sexual Misconduct and are required to report violations of this policy to the appropriate University officials. The IUPD has a collaborative working relationship with the University’s Title IX officials when conducting criminal investigations.
Title IX Investigations
The IUPD will not cause a Title IX investigation to be delayed pending the outcome of a criminal investigation, except for the collection of evidence (13.2.7 a).
The Indiana University Sexual Misconduct and Title IX Coordinator or Deputy Sexual Misconduct and Title IX Coordinators will have access to IUPD investigation notes and findings as necessary for their Title IX investigation, as long as it does not compromise the criminal investigation or prosecution of the criminal case (13.2.7 b).
The division chief or their designee will determine the availability of investigation notes and findings to avoid compromising a criminal investigation and may consult with the Office of the Vice President and General Counsel and/or the local prosecutor’s office as necessary.
