G7.1.8 Physical Restraint by Non-Sworn Officers

Purpose
To provide the Indiana University Police Department (IUPD) with guidance concerning the use of physical restraints by non-sworn officers, referred to in this directive as “non-sworn personnel.”
General Order
Non-sworn personnel will not physically restrain individuals unless they have a reasonable belief that they are defending themselves from a physical assault, or another person from an assault likely to result in serious bodily injury or death, or at the direction of a sworn officer (7.1.8 a).
Definitions
Reasonable Belief –a belief that would be considered reasonable from the perspective of any person in that situation.
Serious Bodily Injury – defined by Indiana Code 35-31.5-2-292 means bodily injury that creates a substantial risk of death or that causes serious permanent disfigurement, unconsciousness, extreme pain, permanent or protracted loss or impairment of the function of a bodily member or organ, or loss of a fetus.
Permissible restraint methods (7.1.8 b)
The IUPD does not issue restraints to non-sworn personnel. Non-sworn personnel may use any technique or object available to them at the time to defend themselves from a physical assault, or another person from an assault likely to result in serious bodily injury or death, or at the direction of a sworn officer.
Conditions under which a restrained individual may be released (7.1.8 c)
Persons who are restrained by non-sworn personnel will be released to or at the direction of a sworn officer or supervisor.
Procedures for documenting the restraint (7.1.8 d)
Non-sworn personnel will follow the procedures outlined in G7.1.10 Reporting Use of Force Incidents for any incident meeting the criteria, including any incident where non-sworn personnel restrain an individual.
